TERMS OF SERVICE – BIKERS GARAGE CO

1. OVERVIEW
This website is operated by BIKERS GARAGE CO, Registration Number 2023/674466/07, a private company registered in South Africa (“Bikers Garage Co”, “we”, “us” or “our”).
These Terms of Service govern your use of our website and your purchase of products or services from Bikers Garage Co. Our online store is hosted by Shopify.
By accessing our website, creating an account or placing an order, you agree to these Terms of Service together with our Privacy Policy, Refund Policy and Shipping Policy.
Nothing in these Terms is intended to exclude, restrict or waive any rights that a consumer may have under applicable South African law, including the Consumer Protection Act 68 of 2008 (“CPA”) and the Electronic Communications and Transactions Act 25 of 2002 (“ECTA”), where applicable.
2. PRODUCTS AND PRODUCT INFORMATION
Bikers Garage Co sells motorcycle parts, spares, accessories and related products, including original, replacement and aftermarket products.
We make reasonable efforts to ensure that product descriptions, photographs, specifications, fitment information, pricing and availability are accurate. However, manufacturers and suppliers may change specifications, packaging, colours or designs without notice.
Product photographs are illustrative and colours or appearance may vary depending on your device or screen settings.
Unless specifically stated otherwise, a product described as aftermarket is not represented as being manufactured or endorsed by the original motorcycle manufacturer.
3. MOTORCYCLE PART FITMENT
Motorcycle parts can vary according to model, year, market specification, VIN/chassis number, engine number and previous modifications.
Fitment information provided on our website is intended to assist customers in identifying suitable products. Customers should carefully check the product description, measurements, specifications, part numbers and listed fitment before ordering.
Where there is uncertainty, we strongly recommend contacting Bikers Garage Co before ordering. We may request information such as the motorcycle make, model, year, VIN/chassis number, engine number, existing part number, measurements or photographs.
Where a customer supplies incorrect or incomplete motorcycle information or orders an incorrect part despite accurate fitment information having been provided, the return may be treated as a change-of-mind or incorrectly ordered item in accordance with our Refund Policy and applicable law.
This does not limit a customer's statutory rights where Bikers Garage Co supplied an incorrect, defective or otherwise non-compliant product.
4. ORDERS AND ACCEPTANCE
Placing an order constitutes an offer to purchase the selected products.
An automated order confirmation does not necessarily mean that an order has been finally accepted. Orders remain subject to payment confirmation, stock availability, pricing verification and any necessary fraud or order checks.
We reserve the right to decline or cancel an order where reasonably necessary, including where a product is unavailable, an obvious pricing or listing error has occurred, payment cannot be verified, or we reasonably suspect fraudulent activity.
If we cancel an order after receiving payment, any amount due to the customer will be refunded using an appropriate payment method.
5. STOCK AVAILABILITY
We make reasonable efforts to keep online stock quantities accurate. Occasionally an item may be sold, damaged, incorrectly counted or otherwise unavailable before our online inventory is updated.
If an ordered product is unavailable, we will contact the customer and, where appropriate, offer an alternative, backorder/special-order option or refund.
6. PRICING AND PAYMENT
All prices are displayed in South African Rand (ZAR) unless otherwise stated.
Bikers Garage Co is currently not VAT registered, and prices therefore do not include VAT charged by Bikers Garage Co.
Delivery charges may be additional and will either be displayed during checkout or quoted separately where the size, weight, destination or nature of the product requires a shipping quotation.
Orders will only be processed once the required payment has been successfully received or confirmed.
Payment may be made using the payment methods made available at checkout.
For EFT/bank-transfer payments, customers must use their order number as the payment reference. Processing may be delayed until funds have cleared and can be verified.
7. SPECIAL-ORDER PRODUCTS
Certain products may be specifically sourced or ordered for a customer and will be identified or communicated as Special Order items.
Special-order items may require full payment or a deposit before the order is placed with the supplier.
Estimated lead times are estimates only. International supplier orders may commonly take approximately 2–3 weeks or longer, depending on supplier availability, international transport, customs, courier delays and other circumstances outside our reasonable control.
Special-order products sourced specifically according to a customer's request may not qualify for ordinary change-of-mind returns or cancellations once the supplier order has been placed, subject always to any rights the customer has under applicable South African law.
This does not remove any statutory rights relating to defective, incorrectly supplied or otherwise non-compliant goods.
8. RETURNS, REFUNDS AND EXCHANGES
Returns, exchanges and refunds are handled in accordance with our Refund Policy and applicable South African law.
Customers should contact us before returning any product so that we can provide the appropriate return instructions.
Products being returned for reasons other than a defect or an error by Bikers Garage Co should, where applicable, be unused, uninstalled and in suitable condition with their original packaging and components.
A product will not automatically be considered defective merely because it is incompatible with a motorcycle for which it was not designed or because incorrect fitment information was supplied by the customer.
Nothing in this section limits statutory remedies available for defective or unsafe goods under applicable law.
9. ELECTRICAL, ELECTRONIC AND INSTALLED PARTS
Customers should confirm compatibility before installing electrical, electronic or model-specific components.
Installation, modification, damage or incorrect use of a product may affect whether it can reasonably be resold or whether a claimed defect resulted from the product itself.
Where a product is alleged to be defective, Bikers Garage Co may reasonably inspect or arrange assessment of the product to determine the nature and cause of the fault.
We will not refuse a legitimate statutory remedy merely because packaging has been opened or an item has been installed where installation was reasonably necessary to discover a defect.
10. INSTALLATION AND SAFETY
Motorcycle components should be installed correctly and in accordance with the motorcycle and component manufacturer's specifications.
Parts affecting braking, steering, suspension, fuel systems, wheels, tyres, drivetrain or other safety-critical systems should be installed or checked by a suitably competent person.
Bikers Garage Co is not responsible for loss or damage caused by incorrect installation, misuse, unauthorised modification, accident, neglect, abnormal use or failure to follow appropriate installation or maintenance requirements, to the extent permitted by law.
Nothing in these Terms excludes liability that cannot legally be excluded under South African law.
11. SHIPPING AND DELIVERY
Orders may be delivered using third-party courier services. Courier selection may depend on destination, parcel dimensions, weight, service availability and cost.
Delivery dates and transit times provided by Bikers Garage Co or a courier are estimates unless expressly stated otherwise.
Bulky, unusually shaped, heavy or special products may require a separate delivery quotation. Where applicable, we will contact the customer before arranging shipment.
Customers are responsible for supplying an accurate and accessible delivery address and correct contact details.

Nothing in these Terms transfers delivery risk to a consumer earlier than permitted by applicable South African law.
12. DAMAGED OR INCORRECT DELIVERIES
Customers should inspect their order as soon as reasonably possible after delivery.
If an order arrives damaged, incomplete or incorrect, please contact us promptly and provide the order number together with photographs or other reasonable information that will help us investigate the issue.
Customers should retain the product and packaging while a courier damage claim is being investigated.
13. WARRANTIES AND DEFECTIVE GOODS
Products may carry manufacturer or supplier warranties where applicable.
Any manufacturer or supplier warranty is additional to, and does not replace, statutory consumer rights that apply under South African law.
Where the CPA applies, qualifying goods are subject to the statutory warranty and remedies provided by the Act.
Warranty claims may require reasonable inspection or testing to establish the nature and cause of the reported fault.
Damage resulting from misuse, incorrect installation, accident, modification, normal wear and tear or use contrary to the manufacturer's specifications may not constitute a product defect.
14. ERRORS AND INACCURACIES
We reserve the right to correct genuine typographical errors, inaccurate product information, stock errors or obvious pricing errors.
If an error affects an order already placed, we will contact the customer and deal with the order in accordance with applicable law.
15. THIRD-PARTY SERVICES
Our website may use services provided by third parties, including Shopify, payment providers, courier companies and other technology providers.
These third parties may have their own terms and privacy policies.
Sales made through this store are transactions between the customer and Bikers Garage Co. Shopify is the technology platform that enables us to operate the online store and is not the seller of our products.
16. INTELLECTUAL PROPERTY
Unless otherwise stated, the Bikers Garage Co name, branding, original website content, graphics and other materials created by or for Bikers Garage Co may not be copied, reproduced or commercially exploited without permission.
Third-party trademarks, manufacturer names, motorcycle model names and product brands remain the property of their respective owners and may be used on our website for legitimate product identification and fitment purposes.
17. PRIVACY
Personal information submitted through our website is handled in accordance with our Privacy Policy and applicable South African privacy legislation, including the Protection of Personal Information Act 4 of 2013 (POPIA) where applicable.
Our store is hosted by Shopify and certain information may be processed by Shopify and other service providers in order to operate the store, process payments, fulfil orders and provide related services.
18. LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, Bikers Garage Co will not be liable for losses resulting from circumstances outside our reasonable control or from a customer's misuse, incorrect installation or unauthorised modification of a product.
Nothing in these Terms is intended to exclude or restrict liability or consumer remedies that cannot lawfully be excluded or restricted under South African law.
19. PROHIBITED USE
You may not use our website or services for unlawful or fraudulent purposes, interfere with the security or operation of the website, introduce malicious software, attempt unauthorised access, misuse another person's personal information, or infringe intellectual-property rights.
We may restrict access where reasonably necessary to protect the website, our customers or Bikers Garage Co.
20. GOVERNING LAW
These Terms and transactions with Bikers Garage Co are governed by the laws of the Republic of South Africa.
Any dispute will be dealt with in accordance with applicable South African law and through courts, tribunals or other dispute-resolution mechanisms having lawful jurisdiction.
Nothing in this section prevents a consumer from exercising any right to approach an appropriate consumer protection body, tribunal or other forum available under applicable law.
21. CHANGES TO THESE TERMS
We may update these Terms from time to time to reflect changes to our business, website, services or applicable requirements.
The version published on our website at the time of a transaction will apply to that transaction unless applicable law requires otherwise.
22. SEVERABILITY
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
